Understanding Part 2 of the Register of Property Occupation Act – A Guide for Landlords and Hosts

HM Government of Gibraltar has introduced Part 2 of the Register of Property Occupation Act. This makes important changes to how short-term rental accommodations are regulated in Gibraltar.

If you are a landlord or a host offering stays through platforms like Airbnb, Booking.com, or even private arrangements, it is essential to understand what this new law means for you and what steps you need to take to comply.

At its core, the Act brings short-term rental activity under a formal registration framework. If you are offering accommodation for periods of up to 30 days for tourism or business purposes, your property now falls under the definition of “short-term rental accommodation services.”

Before you advertise or host anyone, you will need to register the details of the property in the Register of Property Occupation.

Another requirement introduced by the Act is the submission of regular booking returns. Hosts must report to the Registrar details such as the number of guests hosted, the duration of their stays, and the income generated from the rentals, as well as evidence that the sustainable tourism fee has been paid.
